HOUSE CONCURRENT RESOLUTION NO. 40\

Requesting the Joint Committee on Government and Finance to make
a study of the use of bioptic telescopic devices by drivers
with vision impairment and to study the feasibility of
establishing a program to evaluate, train and certify
visually impaired persons to drive on roads and highways in
West Virginia with the use of the devices.
Whereas, The Legislature has an interest in facilitating
employment and independent living of its visually impaired
citizens; and
Whereas, Other states have successfully initiated programs
which provide evaluation, training and certification of visually
impaired citizens to drive using bioptic telescopic devices; and
Whereas, The Legislature desires to explore the potential
benefits and risks associated with the use of bioptic lenses by
visually impaired drivers; therefore, be it
Resolved by the Legislature of West Virginia:
That the Joint Committee on Government and Finance is hereby
requested to review, examine and study the use of telescopic
bioptic devices by drivers and the success of existing programs
that evaluate, train and certify motor vehicle drivers to use
these devices, and to make recommendations to the Legislaturerelated to their study; and, be it
Further Resolved, That the Joint Committee on Government and
Finance report to the regular session of the Legislature, 1997,
on its findings, conclusions and recommendations, together with
drafts of any legislation necessary to effectuate its
recommendations; and, be it
Further Resolved, That the expenses necessary to conduct
this study, to prepare a report and to draft necessary
legislation be paid from legislative appropriations to the Joint
Committee on Government and Finance.
